TigerFox One (1) Year Limited Warranty

IMPORTANT: BY USING YOUR TIGERFOX PRODUCT, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THE TIGERFOX 1 YEAR LIMITED WARRANTY (“WARRANTY”) AS SET OUT BELOW.

DO NOT USE YOUR PRODUCT UNTIL YOU HAVE READ THE TERMS OF THE WARRANTY.

IF YOU DO NOT AGREE TO THE TERMS OF THE WARRANTY, DO NOT USE THE PRODUCT AND RETURN IT WITHIN THE RETURN PERIOD STATED IN TIGERFOX’S RETURN POLICY (FOUND AT RETURNS & REFUNDS) TO THE TIGERFOX OWNED ONLINE STORE OR THE AUTHORIZED DISTRIBUTOR WHERE YOU PURCHASED IT FOR A REFUND.

For TigerFox Branded Products Only. This warranty applies only to purchased TigerFox-branded products and product accessories that were contained in the original packaging, “TigerFox Product”.

HOW CONSUMER LAW RELATES TO THIS WARRANTY

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE (OR BY COUNTRY OR PROVINCE). OTHER THAN AS PERMITTED BY LAW, TIGERFOX DOES NOT EXCLUDE, LIMIT OR SUSPEND OTHER RIGHTS YOU MAY HAVE, INCLUDING THOSE THAT MAY ARISE FROM THE NONCONFORMITY OF A SALES CONTRACT. FOR A FULL UNDERSTANDING OF YOUR RIGHTS YOU SHOULD CONSULT THE LAWS OF YOUR COUNTRY, PROVINCE OR STATE.

WARRANTY LIMITATIONS SUBJECT TO CONSUMER LAW

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THIS WARRANTY AND THE REMEDIES SET FORTH ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED. TIGERFOX, ITS EMPLOYEES, AGENTS, AND AUTHORIZED REPRESENTATIVES DISCLAIM ALL STATUTORY AND IMPLIED WARRANTIES, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS, TO THE EXTENT PERMITTED BY LAW. IN SO FAR AS SUCH WARRANTIES CANNOT BE DISCLAIMED, TIGERFOX LIMITS THE DURATION AND REMEDIES OF SUCH WARRANTIES TO THE DURATION OF THIS EXPRESS WARRANTY AND, AT TIGERFOX’S OPTION, THE REPAIR OR REPLACEMENT SERVICES DESCRIBED BELOW. SOME STATES (COUNTRIES AND PROVINCES) DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY (OR CONDITION) MAY LAST, SO THE LIMITATION DESCRIBED ABOVE MAY NOT APPLY TO YOU.

WHEN WARRANTY BEGINS AND ENDS.

Warranty begins when you purchase the TigerFox product and ends ONE (1) YEAR from the date of original purchase by the end-user purchaser (“Warranty Period”). To obtain your Warranty, register your TigerFox Product and your TigerFox registration or serial number (“Warranty Number”) with TigerFox. Your original invoice or sales receipt will be your Warranty Confirmation. The price of the Warranty is contained in the original cost of the product.

WHAT IS COVERED BY THIS WARRANTY?

TigerFox, Inc. of Milwaukee, Wisconsin, U.S.A. (“TigerFox”) warrants the TigerFox-branded hardware product (“TigerFox Product”) against defects in materials and workmanship when used normally in accordance with TigerFox’s published guidelines. TigerFox’s published guidelines include but are not limited to information contained in technical specifications, user manuals and service communications.

WHAT IS NOT COVERED BY THIS WARRANTY?

This Warranty does not apply to any non-TigerFox branded products, even if packaged or sold with TigerFox Product. Manufacturers, suppliers, or publishers, other than TigerFox, may provide their own warranties to you – please contact them for further information. Music software distributed by TigerFox with or without the TigerFox brand is not covered by this Warranty. TigerFox does not warrant that the operation of the TigerFox Product will be error-free. TigerFox is not responsible for damage arising from failure to follow instructions relating to the TigerFox Product’s use. This Warranty does not extent to the set-up, removal or disposal of the TigerFox Product, preventative maintenance on the TigerFox Product, or the provision of products or equipment while the TigerFox Product is being serviced.

This Warranty does not apply: (a) to consumable TigerFox parts, such as batteries for add-on luminaries; (b) to cosmetic damage, including but not limited to superficial scratches, dents and discolorations in the materials; (c) to damage caused by use with a non TigerFox Product; (d) to damage caused by accident, abuse, misuse, liquid contact, fire, earthquake or other external cause; (e) to damage caused by operating the TigerFox Product outside TigerFox’s published guidelines; (f) to damage caused by modifications performed by anyone who is not an authorized representative of TigerFox; (g) to a TigerFox Product that has been modified to alter functionality or capability without the written permission of TigerFox; (h) to defects caused by normal wear and tear or otherwise due to the normal aging of the TigerFox Product, or (i) if any serial number has been altered, defaced, or removed from the TigerFox Product. (j) This Warranty does not apply to equipment that has been lost or stolen. (k) This Warranty only covers the TigerFox Products returned to TigerFox in their entirety.

YOUR RESPONSIBILITIES

To receive service or support under the Warranty, you agree to comply with the following:

(i) Provide your TigerFox Product’s serial number and a copy of your TigerFox Product’s original proof of purchase, if requested;

(ii) Provide information about the symptoms and causes of the issues with your TigerFox Product to assist with diagnosing potential issues;

(iii) Respond to requests for information, including but not limited to the TigerFox Product’s serial number, model, any electronic devices connected or used with the TigerFox Product, actions taken before the TigerFox Product experienced the issue and steps taken to resolve the issue;

(iv) Follow instructions TigerFox gives you, including but not limited to refraining from sending TigerFox Products and accessories that are not subject to repair or replacement service and packing the TigerFox Product in accordance with shipping instructions;

(v) Following warranty service, your TigerFox Product or a replacement device will be returned to you, subject to applicable TigerFox modifications and updates.

WHAT WILL TIGERFOX DO IN THE EVENT THE WARRANTY IS BREACHED?

If during the Warranty Period you submit a valid claim to TigerFox, TigerFox will, at its option, (i) repair the TigerFox Product using new or previously used parts that are equivalent to new in performance and reliability, (ii) replace the TigerFox Product with a device that is at least functionally equivalent to the TigerFox Product and is formed from new and/or previously used parts that are equivalent to new in performance and reliability, or (iii) exchange the TigerFox Product for a refund of your purchase price.

TigerFox may request that you replace certain user-repairable replacement parts. A replacement part, including a user-installable part that has been installed in accordance with instructions provided by TigerFox, assumes the remaining term of the Warranty. When a TigerFox Product or part is replaced or a refund provided, any replacement item becomes your property and the replaced or refunded item becomes TigerFox’s property.

HOW TO OBTAIN WARRANTY SERVICE?

Please access and review the online help resources described at the lower part of this document before seeking warranty service. If the TigerFox Product is still not functioning properly after making use of these resources, please contact a TigerFox representative, or email TigerFoxCustomerService@gmail.com using the information provided below. A TigerFox representative will help determine whether your TigerFox Product requires service and, if it does, will inform you how TigerFox will provide it. When contacting TigerFox, connection and other charges may apply depending on your location.

If calling, provide your TigerFox representative with your TigerFox Product’s serial number. KEEP YOUR ORIGINAL SALES RECEIPT or INVOICE FOR YOUR TIGERFOX PRODUCT, as it will be required if there is any question as to your product’s eligibility for coverage.

Online information with details on obtaining warranty service is provided below.

WARRANTY SERVICE OPTIONS

TigerFox will provide warranty service through one or more of the following options:

(i) If TigerFox determines that your TigerFox Product is eligible for return, you will receive a Return Authorization Number and a TigerFox U.S. return shipping address. You may then package and ship your returned TigerFox Product in its original shipping carton to the provided TigerFox U.S. return shipping address in accordance with TigerFox’s instructions. Once service is complete, the TigerFox Store will return your TigerFox Product to you at your original U.S. shipping address.

(ii) Do-it-yourself (DIY) parts service. DIY parts service may be available for many TigerFox Products and parts, allowing you to service your own product. If DIY parts service is available in the circumstances, the following process will apply.

(a) Service where TigerFox requires return of the replaced TigerFox Product or part. TigerFox may require a credit card authorization as security for the retail price of the replacement TigerFox Product or part and applicable shipping costs. If you are unable to provide credit card authorization, DIY parts service may not be available to you and TigerFox will offer alternative arrangements for service. TigerFox will ship a replacement TigerFox Product or part to you with installation instructions, if applicable, and any requirements for the return of the replaced TigerFox Product or part. If you follow the instructions, TigerFox will cancel or credit back the credit card authorization for the replacement part, so you will not be charged for the replaced product or part. If you fail to return the replaced product or part if instructed or return a replaced product or part that is ineligible for service, TigerFox will charge the credit card for the authorized amount.

(b) Service where TigerFox does not require return of the replaced TigerFox Product or part. TigerFox will ship you free of charge a replacement TigerFox Product or part accompanied by appropriate instructions, and any disposal instructions for the replaced TigerFox Product or part. Proof of discontinued use, such as a photograph of the disabled part, may be required if the TigerFox Product or part is not returned.

(c) TigerFox is not responsible for any labor costs you incur relating to DIY parts service. Should you require further assistance, please email TigerFox at TigerFoxCustomerService@gmail.com with your request for further assistance.

TigerFox reserves the right to change the method by which TigerFox may provide warranty service to you, and your TigerFox Product’s eligibility to receive a particular method of service. Service will be limited to the options available in the country where service is requested. Service options, parts availability and response times may vary. You may be responsible for shipping and handling charges. If you seek service in a country that is not the country of purchase, you will need to comply with all applicable import and export laws and regulations and be responsible for all custom duties, V.A.T. and other associated taxes and charges. For international service, where TigerFox service is available, TigerFox Products and parts may be repaired or replaced with comparable products and parts.

LIMITATION OF LIABILITY

EXCEPT AS PROVIDED IN THIS WARRANTY AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIGERFOX, ITS EMPLOYEES, AGENTS, AND AUTHORIZED REPRESENTATIVES ARE NOT RESPONSIBLE FOR DIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF ACTUAL OR ANTICIPATED PROFITS (INCLUDING LOSS OF PROFITS ON CONTRACTS); LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF BUSINESS; LOSS OF OPPORTUNITY; LOSS OF GOODWILL; LOSS OF REPUTATION; OR ANY INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE HOWSOEVER CAUSED INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LIMIT OF TIGERFOX, ITS EMPLOYEES, AGENTS, AND AUTHORIZED REPRESENTATIVE’S LIABILITY TO YOU AND ANY SUBSEQUENT OWNER ARISING UNDER THE WARRANTY SHALL NOT EXCEED THE ORIGINAL PRICE PAID FOR THE TIGERFOX PRODUCT.

TIGERFOX’S LIABILITY IS LIMITED AND ITS SOLE OPTION IS TO REPLACE OR REPAIR OF THE TIGERFOX PRODUCT. THE FOREGOING LIMITATION SHALL NOT APPLY TO DEATH OR PERSONAL INJURY CLAIMS, OR ANY STATUTORY LIABILITY FOR INTENTIONAL AND GROSS NEGLIGENT ACTS AND/OR OMISSIONS. TIGERFOX DISCLAIMS ANY REPRESENTATION THAT IT WILL BE ABLE TO REPAIR ANY TIGERFOX PRODUCT UNDER THIS WARRANTY OR REPLACE THE TIGERFOX PRODUCT WITHOUT RISK TO THE TIGERFOX PRODUCT.

TRANSFER OF WARRANTY 

Transfer of a TigerFox Product to a New Owner. Subject to the restrictions set forth below, you may make a one-time permanent transfer of all of your rights under the Warranty to another party, provided that: (a) the transfer includes the original Proof of Purchase and all of the product’s packaging material, including printed materials and these Terms TigerFoxCustomerService@gmail.com and (c) the party receiving the TigerFox Product accepts the Terms and Conditions of the Warranty. When notifying TigerFox of the transfer of the product and Warranty, you must provide the serial number of the TigerFox Product being transferred and the name, address, telephone number, and email address of yourself and the new owner.

PRIVACY

TigerFox will maintain and may use customer information in accordance with the TigerFox Customer Privacy Policy available at the Privacy Policy section in this document.

GENERAL

(i) TigerFox may subcontract or assign performance of its obligations to third parties but shall not be relieved of its obligations to you in doing so.

(ii) TigerFox is not responsible for any failures or delays in performing under the Warranty that are due to events outside TigerFox’s reasonable control.

(iii) You are not required to perform preventative maintenance on the TigerFox Product to receive service under the Warranty.

(iv) This Warranty is offered and valid only if you are a resident of the fifty states of the United States of America, the District of Columbia, Canada and other countries in which TigerFox or its affiliated companies offers the Warranty. This Warranty is not offered to persons who have not reached the age of majority. This Warranty is not available where prohibited by law.

(v) In carrying out its obligations TigerFox may, at its discretion and solely for the purposes of monitoring the quality of TigerFox’s response, record part or all of the calls and emails between you and TigerFox. This information will remain strictly confidential and is for internal TigerFox use only.
