Intellectual Property Theft
Intellectual property theft (the illegal copying, reproduction, sale, or unauthorized use of another’s work) is a far-reaching problem — every year more than $11 billion is lost to intellectual property theft. Intellectual property theft is also a harmful and serious crime. Because intellectual property is valuable and conceivably easy to replicate, intellectual property theft is a universal responsibility, both locally and abroad.

TigerFox aggressively enforces its intellectual property rights and vigorously pursues legal action to the fullest extent of the law. In this regard, TigerFox works closely with the federal government, local law offices and authorities to pursue the unauthorized use or reproduction of TigerFox products, components, trademarks and copyright materials worldwide. In the United States and in many other countries, patent, trademark and copyright laws administer severe criminal and civil penalties for the unauthorized reproduction, distribution or use of intellectual property products and materials. Infringement under U.S. law authorizes punishment of up to $150,000.00 in civil damages, with criminal penalties of up to five years imprisonment and fines of $250,000.00 per infringement.

Your feedback helps us to help you.
TigerFox welcomes your feedback on its products and services, including many areas of TigerFox’s existing business. If you would like to send us your comments, feedback, suggestions or report any problem you experienced, including problems with a particular component, and we hope you do, we simply request that you email your feedback to: TigerFoxSound@gmail.com – Attention: Product Feedback. We’d very much like to hear about it. It’s just one more way that TigerFox can learn how to best satisfy your needs.

Please include the TigerFox product or service you’re providing feedback on, any associated equipment or system components, and your email address for reference. It is helpful to include your system’s configuration including your system components.

Please include, however, only specific feedback on TigerFox’s existing products or marketing strategies. We read all feedback carefully, but please note that we cannot respond to the comments that you submit. Any feedback you provide shall be deemed to be non-confidential. TigerFox shall be free to use such information on an unrestricted basis. Please do not include any ideas that TigerFox’s policy will not permit it to accept or consider (see below “Unsolicited Idea Submission Policy”).

Unsolicited Idea Submission Policy
TigerFox maintains an exceptionally strong commitment to research and product development. TigerFox or any of its employees do not accept or consider unsolicited ideas, including ideas for new advertising campaigns, new promotions, new or improved products or technologies, product enhancements, processes, materials, marketing plans or new product names. Please do not submit any unsolicited ideas, original creative artwork, suggestions or other works (“submissions”) in any form to TigerFox or any of its employees. The sole purpose of this policy is to avoid potential misunderstandings or disputes when TigerFox’s products or marketing strategies might seem similar to ideas submitted to TigerFox. This is because researching new technologies, incorporating product research into products, and developing marketing strategies for our products may take several years before being introduced to the public.

If, despite our request that you not send us your ideas, you still submit them, then regardless of what your letter says, the following terms shall apply to your submissions.

Terms Of Idea Submission
You agree that: (1) your submissions and their contents will automatically become the property of TigerFox, without any compensation to you; (2) TigerFox may use or redistribute the submissions and their contents for any purpose and in any way; (3) there is no obligation for TigerFox to review the submission; and (4) there is no obligation to keep any submissions confidential.

Guidelines for Using TigerFox Trademarks and Copyrights

(Guidelines for parties wishing to use TigerFox trademarks, images or copyright materials.)

These guidelines are for TigerFox licensees, authorized resellers, customers, and other parties wishing to use TigerFox’s trademarks, service marks or images in promotional, advertising, instructional, or reference materials, or on their web sites, products, labels, or packaging. Use of the TigerFox Logo for commercial purposes without the prior written consent of TigerFox may constitute trademark infringement and unfair competition in violation of federal and state laws. Use of TigerFox trademarks may be prohibited, unless expressly authorized.

If you are a licensee of a TigerFox trademark or logo and have been provided with special trademark usage guidelines with your license agreement, please follow those guidelines. If your license agreement does not provide usage guidelines, then follow these guidelines. If you are a TigerFox Authorized Reseller or member of a TigerFox program, you may be subject to additional restrictions.

TigerFox’s trademarks, service marks, trade names, and trade dress are valuable assets. In following these guidelines, you help us protect our valuable trademark rights and strengthen our corporate and brand identities. By using a TigerFox trademark, in whole or in part, you are acknowledging that TigerFox is the sole owner of the trademark and promising that you will not interfere with TigerFox’s rights in the trademark, including challenging TigerFox’s use, registration of, or application to register such trademark, alone or in combination with other words, anywhere in the world, and that you will not harm, misuse, or bring into disrepute any TigerFox trademark. The goodwill derived from using any part of a TigerFox trademark exclusively belongs to, and for the benefit of, TigerFox. Except for the limited right to use as expressly permitted under these Guidelines, no other rights of any kind are granted hereunder, by implication or otherwise. I TIGERFOX TRADEMARKS

A. AUTHORIZED USE OF TIGERFOX TRADEMARKS

1. Advertising, Promotional, and Sales Materials: Only TigerFox and its authorized resellers and licensees may use the TigerFox Logo in advertising, promotional, and sales materials. Such authorized parties may use the TigerFox Logo only as specified in their agreement with TigerFox and any associated Guidelines and such use must always be in conjunction with the appropriate terms that define the relationship authorized by their contract with TigerFox. For example:

Authorized TigerFox Distributor
Authorized TigerFox Independent Representative

2. Compatibility: With prior written approval from TigerFox, Inc. third party manufacturers of comparable electronic equipment may use TigerFox, or any other TigerFox word mark (but not the TigerFox Logo or other TigerFox-owned graphic symbol/logo) in a referential phrase on packaging or promotional/advertising materials to describe that the third party product is compatible with the referenced TigerFox product or technology, provided they have prior written approval from TigerFox, Inc. and comply with the following requirements.
a. The TigerFox word mark is not part of the product name.
b. The TigerFox word mark is used in a referential phrase such as “for use with,” or “compatible with.”
c. The TigerFox word mark appears less prominent than the product name.
d. The product is in fact compatible with, or otherwise works suitably-well with, the referenced TigerFox product.
e. The reference to TigerFox does not create a sense of endorsement, sponsorship, or false association with TigerFox or TigerFox products or services.
f. The use does not show TigerFox or its products in a false or derogatory light.
3. Publications, Seminars, and Conferences: You may use a TigerFox word mark in connection with book titles, articles, magazines, periodicals, seminars, or conferences provided you comply with the following requirements:
a. The use is referential and less prominent than the rest of the title. Acceptable: “XYZ Conference” or “XYZ Get-Together for TigerFox Users”.
b. The use reflects favorably on both TigerFox, Inc., and TigerFox products or technology.
c. Your name and logo appear more prominent than the TigerFox word mark on all printed materials related to the publication, seminar or conference.
d. The TigerFox logo or any other TigerFox-owned graphic symbol, logo, icon or image does not appear on or in the publication or on any materials related to the publication, seminar, or conference without express written permission from TigerFox.
e. A disclaimer of sponsorship, affiliation, or endorsement by TigerFox, similar to the following, is included on the publication and on all related printed materials: “(Title) is an independent (publication) and has not been authorized, sponsored, or otherwise approved by TigerFox, Inc.”
f. A trademark attribution notice is included in the credit section giving notice of TigerFox’s ownership of its trademark(s). Please refer to the section below titled “Proper TigerFox Trademark Notice and Attribution.”

4. Web Sites: Web sites that serve only as noncommercial electronic informational forums concerning a TigerFox product or technology may use the appropriate TigerFox word mark, provided such use complies with the guidelines set forth in Section 3 above.

B. UNAUTHORIZED USE OF TIGERFOX TRADEMARKS

1. Company, Product, or Service Name: You may not use or register, in whole or in part, TigerFox, or any other TigerFox trademark, including TigerFox-owned graphic symbols, logos, icons, or an alteration thereof, as or as part of a company name, trade name, product name, or service name except as specifically noted in these guidelines.

2. TigerFox Logo and TigerFox-owned Graphic Symbols: You may not use the TigerFox Logo or any other TigerFox-owned graphic symbol, logo, or icon on or in connection with web sites, products, packaging, manuals, promotional/advertising materials, or for any other purpose except pursuant to an express written trademark license from TigerFox, such as an Authorized TigerFox Retail Reseller agreement.

3. Variations, Takeoffs or Abbreviations: You may not use an image of a real tiger or fox or other variation of the TigerFox logo for any purpose. Third parties cannot use a variation, phonetic equivalent, foreign language equivalent, takeoff, or abbreviation of a TigerFox trademark for any purpose. For example:

4. Disparaging Manner: You may not use an TigerFox trademark or any other TigerFox-owned graphic symbol, logo, or icon in a disparaging manner.

5. Endorsement or Sponsorship: You may not use TigerFox, or any other TigerFox trademark, including TigerFox-owned graphic symbols/logos, or icons, in a manner that would imply TigerFox’s affiliation with or endorsement, sponsorship, or support of a third party product or service.

6. Merchandise Items: You may not manufacture, sell or give-away merchandise items, such as T-shirts and mugs, bearing TigerFox, or any other TigerFox trademark, including symbols, logos, or icons, except pursuant to an express written trademark license from TigerFox.

7. TigerFox’s Trade Dress: You may not imitate the distinctive TigerFox packaging, web site design, logos, or typefaces.

8. Slogans and Tag Lines: You may not use or imitate a TigerFox slogan or tagline.
For example: “Holographic Music Playback In True Three Dimensions.”

9. Domain Names: You may not use an identical or virtually identical TigerFox trademark as a second level domain name.
Not acceptable examples:    “TigerFox.com”       “TigerFoxSpeakers.com”

C. THE TIGERFOX TRADEMARK – USAGE GUIDELINES
1. You may not use the TigerFox trademark standing alone except to denote or refer to the TigerFox product line.
2. You may use “TigerFox” in your product name, company name, trade name, or service name provided prior written approval is obtained from TigerFox, Inc. and your product and name satisfies the following criteria:
a. Your specific product and model has been pre-tested by TigerFox, Inc., such as a TigerFox pre-tested specific speaker, amplifier, listening room device, music therapy aid, sound control material, etc. and your specific product has been pre-approved and pre-authorized by TigerFox, Inc.
b. Your product is TigerFox compatible or the third party business is associated with TigerFox based products.
c. “TigerFox” does not appear more prominently than the rest of the name in size, color, or typeface.
d. Your name does not suggest a false association with TigerFox.
e. Your name is not confusingly similar to any trademark owned or used by TigerFox.
f. You acknowledge that TigerFox is the sole owner of the “TigerFox” trademark and that you will not interfere with TigerFox’s use or registration of “TigerFox” alone or in combination with other words.
g. If you are a TigerFox Authorized Reseller or member of an TigerFox program, you may be subject to additional restrictions.

D. RULES FOR PROPER USE OF TIGERFOX TRADEMARKS
1. Trademarks are adjectives used to modify nouns; the noun is the generic name of a product or service.
2. As adjectives, trademarks may not be used in the plural or possessive form.
Correct: I bought two TigerFox portable listening rooms.
Not Correct: I bought two TigerFoxes.
3. An appropriate generic term must appear after the trademark the first time it appears in a printed piece, and as often as is reasonable after that.
4. Always spell and capitalize TigerFox’s trademarks exactly. Do not shorten or abbreviate TigerFox product names. Do not make up names that contain the TigerFox trademark.

E. PROPER TRADEMARK NOTICE AND ATTRIBUTION
1. Distribution Within the United States Only
a. On product, product documentation, or other product communications that will be distributed only in the United States, use the appropriate trademark symbol (TM, ®) the first time the TigerFox trademark appears in the text of the advertisement, brochure, or other material.
b. Generally, the symbol appears at the right shoulder of the TigerFox trademark.
c. Include an attribution of TigerFox’s ownership of its trademarks within the credit notice section of your product, product documentation, or other product communication.
Following are the correct formats:
TigerFox is a trademark of TigerFox, Inc, Milwaukee, Wisconsin 53213 USA.
TigerFox is a registered trademark of TigerFox, Inc, Milwaukee, Wisconsin 53213 USA.

2. Distribution Outside the United States:
a. Do not use trademark symbols on products, product documentation, or other product communications that will be distributed outside the United States without prior permission from TigerFox.
b. Use one of the following international credit notices:
TigerFox is a trademark of TigerFox, Inc., Milwaukee, Wisconsin 53213 USA, registered in the U.S. and other countries.
TigerFox is a registered trademark of TigerFox, Inc., Milwaukee, Wisconsin 53213 USA, registered in the U.S. and other countries.

II DEPICTIONS OF TIGERFOX PRODUCTS

A. Endorsement or Sponsorship: TigerFox, without the prior written approval from TigerFox, Inc., does not support the use of its logos, company names, product names, or images of TigerFox products by other parties in marketing, promotional or advertising materials as their use may create the perception that TigerFox endorses or sponsors the product, service or promotion.

B. Compatibility: With prior TigerFox’s written approval, you may show an image of a TigerFox product in your promotional/advertising materials to depict that your product is compatible with, or otherwise works with, the TigerFox product or technology, provided you comply with the following requirements listed here:
a. Your product is in fact compatible with, or otherwise works with, the referenced TigerFox product.
b. The image is an actual photograph of the genuine TigerFox product and not an artist’s rendering (Note: You must obtain express written permission from TigerFox before using any photograph owned or licensed by TigerFox).
c. The TigerFox product is shown only in the best light, in a manner or context that reflects favorably on the TigerFox products and on TigerFox Inc.
d. Unless otherwise agreed upon by TigerFox in writing, the reference to TigerFox does not create a sense of endorsement or sponsorship by, or other false association with, TigerFox or TigerFox products.

III TIGERFOX COPYRIGHT MATERIALS

A copyright can be an original work of authorship including literature, music, graphic images, photographs, videos, etc.

TigerFox allows you to copy documents published by TigerFox on this site for personal and noncommercial use only. Such authorization does not permit the use of copyrighted content from this site for the unauthorized sale of TigerFox products or services. As a condition of this authorization, you agree that any copy you make of these documents shall retain all copyright and other proprietary notices contained herein. This authorization does not include the use of images, logos or other content unless they are embedded within the documents. TigerFox may revoke this authorization at any time, in its sole discretion. Upon any such revocation, you must promptly destroy all materials downloaded or otherwise obtained from this site, as well as all copies of such materials, whether made in accordance with these terms and conditions or otherwise.

For use of TigerFox copyrighted material in third party works e.g., books, articles, or publications, please submit your detailed request to TigerFoxSound@gmail.com and include the following:
• Specific image(s) or material for which you are seeking permission
